3-Bag Challenge - Special Offer Terms and Conditions

Eligibility: 3-Bag Challenge (the “Offer”) is open to legal residents of the fifty (50) United States (including D.C.) who are eighteen (18) years old or older at the time of participation. Employees of Hill's Pet Nutrition, Inc., ePrize, LLC, and their parent and affiliate companies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, are not eligible. Void where prohibited.

Timing: Offer begins on January 1, 2009 at 12:00 a.m. Eastern Time (“ET”) and ends on December 31, 2010 at 11:59 p.m. ET (the "Offer Period"). Sponsor’s computer is the official time-keeping device for the Offer.

How to Receive Offer: During the Offer Period visit www.FeedingisBelieving.com and follow the links and instructions to complete and submit the registration. Your registration must include a valid home street address, P.O. boxes are not permitted. Take the 3-Bag Challenge for your dog and/or your cat and receive valuable gifts in return. All you do is:

Dog Offer:

During the Offer Period, purchase three (3) bags of any of the Hill’s® Science Diet® dog food products that are 3.5 lbs. or larger; and
Following each purchase, visit www.FeedingisBelieving.com, enter your email address to access your registration form, and then enter the UPC Code and Lot Code appearing on the bag of the Science Diet® dog food that you purchased (you are limited to entering one (1) set of UPC/Lot Codes per day).
You have completed the 3-Bag Challenge for your dog once you have entered the UPC/Lot Codes from each of the three bags of Science Diet® dog food that you purchased.

Following your entry of each of the first two (2) sets of UPC/Lot Codes, an online coupon for $5 off your next purchase of any 4 lb. or larger bag of Hill’s® Science Diet® dry dog food (excludes treats) will be available for you to download. Within 4-6 weeks following your entry of the third and final set of UPC/Lot Codes in this Dog Offer, Sponsor will mail you one (1) Dog Care Kit valued at $30 that includes a dog checklist and a dog care booklet.

Cat Offer:

During the Offer Period, purchase three (3) bags of any of the Hill’s® Science Diet® cat food products that are 3 lbs. or larger; and
Following each purchase, visit www.FeedingisBelieving.com, enter your email address to access your registration form, and then enter the UPC Code and Lot Code appearing on the bag of the Science Diet® cat food that you purchased (you are limited to entering one set of UPC/Lot Codes per day).
You have completed the 3-Bag Challenge for your cat once you have entered the UPC/Lot Codes from each of the three bags of Science Diet® cat food that you purchased.

Following your entry of each of the first two (2) sets of UPC/Lot Codes, an online coupon for $5 off your next purchase of any 4.5 lb. or larger Hill’s® Science Diet® dry cat food (excludes treats) will be available for you to download. Within 4-6 weeks following your entry of the third and final set of UPC/Lot Codes in this Cat Offer, Sponsor will mail you one (1) Cat Care Kit valued at $30 that includes a cat care booklet.

Offer Limitations: Limited to one (1) Dog Offer and one (1) Cat Offer per household. Participants are not permitted to share the same email address. Each participant must enter UPC/Lot Codes from products he/she purchased; such UPC/Lot Codes cannot be shared with other participants. Each participant may enter up to three (3) sets of UPC and Lot Codes per species during the entire Offer Period, but may only enter one (1) set of UPC and Lot Codes per day. Coupon terms and conditions apply. Participants must retain point-of-purchase receipts as evidence of each of the three purchases required in the Dog Offer and the Cat Offer.

Release: By receipt of any valuable gift from Sponsor in exchange for your participation in the Offer (Dog Offer and/or the Cat Offer), you hereby agree to release and hold harmless Sponsor, ePrize, LLC, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize/offer suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Offer or receipt or use or misuse of the coupons or the Pet Care Kit.

General Conditions: By participating in the Offer, or any part of the Offer, you are agreeing to be bound by these Terms and Conditions. Sponsor reserves the right to cancel, suspend and/or modify the Offer, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Offer, as determined by Sponsor in its sole discretion. Prior to the provision of any gift, Sponsor reserves the right to require participant provide it with proof of product purchase in the form of a qualifying point-of-purchase receipt. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the registration process or the operation of the Offer or to be acting in violation of these Terms and Conditions or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Offer may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.

The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by participants, printing errors or by any of the equipment or programming associated with or utilized in the Offer; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the registration process or the Offer; (4) technical or human error which may occur in the administration of the Offer or the processing of registrations; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participation in the Offer or receipt or use or misuse of any coupons or Pet Care Kit. No more than the stated number of coupons or Pet Care Kits will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of coupons or Pet Care Kits as set forth in these Terms and Conditions to be available and/or claimed, Sponsor reserves the right to award only the stated number of coupons or Pet Care Kits by a random drawing among all legitimate, un-awarded, eligible coupons or Pet Care Kit claims.

Except where prohibited, participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Offer or any coupons or Pet Care Kit awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Offer, but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the participant and Sponsor in connection with the Offer, shall be governed by, and construed in accordance with, the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
